“Services” refers to all heating and cooling services provided by Immerse Air.
“Goods” includes equipment, components, and materials supplied.
“Site” means the property at which services are carried out.
1. Privacy Policy
Our Privacy Policy, available on this page is incorporated into these Terms of Service by reference. By accessing or using this website or our services, you agree to the terms of that policy and consent to the collection, use, and disclosure of your personal information as described therein.
2. Copyright
All copyright in the materials on this website (including, without limitation, text, graphics, logos, images, and icons) is owned or licensed by Immerse Air Pty Ltd.
You may not, in any form or by any means:
(a) copy, adapt, reproduce, store, distribute, print, display, perform, publish, broadcast, communicate to the public, or create derivative works of the whole or any part of the materials; or
(b) commercialise any part of the materials without our express written permission or, where applicable, the permission of the third-party copyright holder.
3. Booking and Deposit
To secure your booking, a non-refundable deposit of 30% of the quoted price is required. This deposit secures your service appointment and will be applied to the final invoice. The remaining balance is due upon completion of the service.
Ownership of goods supplied remains with Immerse Air until full payment is received. Risk in the goods passes to you upon delivery.
4. Quotes and Pricing
All quotes are valid for 60 days unless otherwise stated. Prices are subject to change due to unforeseen circumstances or variations in the scope of work. Any additional work required will be quoted separately and must be approved by you before commencement.
5. Service Availability and Scheduling
We strive to provide services in a timely manner. However, scheduling is subject to availability. Immerse Air reserves the right to reschedule appointments due to unforeseen circumstances, including but not limited to weather, staff availability, or equipment issues.
6. Customer Responsibilities
You must:
(a) Provide clear and safe access to the work area;
(b) Ensure that essential services (e.g., electricity, water) are available during the works;
(c) Notify us in advance of any hazards or safety concerns (e.g., asbestos, electrical faults, structural issues).
Failure to do so may result in delays, additional charges, or cancellation of services.
You must notify us of any cancellation or rescheduling at least 48 hours in advance. Late cancellations may incur a fee or result in forfeiture of your deposit.
7. Authority to Request Services
By engaging our services, you confirm that you are either the property owner or have obtained all necessary permissions from the property owner or managing agent.
We are not liable for any disputes, damages, or losses arising from a lack of authority to approve works at the property. We may request written confirmation of ownership or authority. We reserve the right to refuse service if sufficient evidence of authority is not provided.
8. Warranties and Liability
We warrant that our services will be delivered with due care and skill. Our liability for any breach is limited to the re-supply of the services or a refund, as permitted by law. We are not liable for any indirect or consequential losses.
Customers are responsible for registering product warranties with manufacturers. Immerse Air is not responsible for manufacturers’ decisions regarding warranty claims, turnaround times, or outcomes.
9. Limitation of Liability
To the fullest extent permitted by law, Immerse Air is not liable for any indirect, incidental, special, or consequential loss or damage arising from or in connection with our services. Our total liability is limited to the amount you paid for the relevant services.
10. Compliance with Laws
You agree to comply with all applicable laws, regulations, codes, and standards relevant to the installation, maintenance, and use of heating and cooling systems, including occupational health and safety and building codes.
We reserve the right to refuse or suspend service if we believe there is a legal or safety breach.
11. Dispute Resolution
In the event of a dispute, both parties agree to attempt to resolve the issue through good faith negotiation. If resolution cannot be reached, the dispute may be referred to mediation. If mediation fails, the matter may be submitted to arbitration or resolved by the appropriate court in Victoria, Australia.
12. Governing Law
These Terms are governed by the laws of Victoria, Australia. By using our website and services, you agree to submit to the exclusive jurisdiction of the courts of Victoria.
13. Force Majeure
We are not liable for any failure or delay in performing our obligations due to events beyond our control, including but not limited to natural disasters, pandemics, strikes, or government restrictions.
14. Amendments to Terms and Website
Immerse Air reserves the right to:
(a) amend these Terms at any time; and
(b) make changes to this website or our services at our discretion.
Changes take effect immediately upon being posted. It is your responsibility to check this page for updates. Continued use of our website or services constitutes your acceptance of the amended Terms.
Note: Any changes to these Terms do not apply to service bookings already accepted. The version in place at the time of booking will apply.
15. Use of Third-Party Services
We use trusted third-party platforms for business operations, including invoicing and payments. These providers may access your personal and payment information as needed, but are required to protect your data and comply with Australian privacy laws.
16. Insurance
Immerse Air holds current public liability and workers’ compensation insurance. You are responsible for ensuring adequate insurance coverage for your property and any third parties affected by our works. Immerse Air is not liable for loss or damage not directly caused by our negligence.
